Comprehensive Trademark Search

Comprehensive Trademark Search: Know the Risk Before You File

A comprehensive search goes beyond an exact-name lookup of the USPTO database. For $209 per proposed mark, an attorney reviews federal and marketplace records for potential conflicts, evaluates the Section 2(d) likelihood-of-confusion risk, and delivers a written attorney risk assessment with a filing recommendation before you invest further in a brand or file an application.
  • $209 per mark

  • 1–3 business days

  • Attorney-reviewed written report

  • High / Moderate / Low risk assessment

Why a Comprehensive Search

Why an exact-name search isn't enough

A basic search for your exact proposed name can miss real conflicts. A comprehensive search looks more broadly at how your mark compares to marks already in use.

Confusing similarity isn't just spelling

Marks can conflict based on similarity in appearance, sound, meaning, and overall commercial impression — not only whether the name matches exactly.

Related goods and services matter

A similar mark used for related goods or services can raise a conflict risk even when the businesses look different on the surface.

Common-law use can matter too

Business names, websites, domain names, and other marketplace uses can carry legal weight, even if they were never federally registered.

Finding risk early can save time and expense

Identifying a conflict before you file — or before you invest heavily in branding, packaging, or marketing — is far less costly than discovering it afterward.

No trademark search can identify every potential conflict, but a broader review can help identify potential risks before you file or invest further in a brand.

Attorney Review

What the attorney evaluates

Federal and marketplace review

  • Identical and similar federal marks
  • Similarity in appearance
  • Similarity in sound
  • Similarity in meaning
  • Overall commercial impression
  • Relatedness of goods and services
  • Common-law and marketplace uses

Risk and strategy analysis

  • Likelihood of a Section 2(d) refusal
  • Overall registration risk (High / Moderate / Low)
  • Ways to strengthen or modify the proposed mark before filing

Your Deliverable

What you receive

At the end of the search, you receive a written, attorney-reviewed clearance report. The finished report generally includes substantive analysis, not merely a list of search results.

  • An executive recommendation
  • Key federal findings
  • Relevant marketplace and common-law findings
  • Section 2(d) likelihood-of-confusion analysis
  • An overall risk assessment: High, Moderate, or Low
  • Filing-strategy recommendations
  • Relevant limitations of the search

A note on search limitations

No trademark search can guarantee that every potentially conflicting use will be identified, and the USPTO independently evaluates every application, so a favorable search does not guarantee registration. Common-law rights may exist outside easily searchable sources, and the analysis reflects information reasonably available at the time of the search.

An Important Distinction

Quick Search vs. Comprehensive Search

The Quick Search helps screen a filing you're ready to make. The Comprehensive Search helps you evaluate whether to invest in and file the mark in the first place. The $209 Comprehensive Search is a separate, deeper service — not a repeat charge for the same work.

Included with filing package

USPTO Quick Search

  • Included with the $500 standard filing package
  • Preliminary USPTO screening
  • Written findings with attorney review
  • Designed to support an application you are ready to file

Separate service — $209

Comprehensive Trademark Search

  • A separate $209 service
  • More extensive review of similar marks — appearance, sound, meaning, and commercial impression
  • Analysis of related goods and services
  • Relevant common-law and marketplace searching
  • Section 2(d) likelihood-of-confusion risk analysis
  • High / Moderate / Low overall risk assessment
  • A detailed written clearance report
  • Filing and branding strategy recommendations

The Process

How it works

  1. 01

Tell us about your proposed mark

Describe your proposed word mark or logo/design and the goods or services you plan to offer, in your own words. You do not need to identify your own International Classes.

  2. 02

    Attorney-led research and conflict analysis

An attorney searches the USPTO database and relevant marketplace sources and evaluates potential conflicts against your proposed mark.

  3. 03

    Receive your written risk assessment

Within 1–3 business days after payment, you receive a written, attorney-reviewed clearance report with a High, Moderate, or Low risk rating.

  4. 04

    Review the recommendation and decide

Use the report to decide whether to file, modify, or reconsider the proposed mark. A brief email follow-up regarding the report is included.

Comprehensive Search FAQ

What does the $209 fee cover?

The $209 fee covers a Comprehensive Trademark Search for one proposed word mark, including USPTO federal and marketplace review, likelihood-of-confusion analysis, and a written, attorney-reviewed clearance report.

Is the price per mark?

Yes. The $209 fee is per proposed word mark searched. The Comprehensive Logo / Design Trademark Search is priced the same way: $209 per individual logo or design.

What if my business spans many trademark classes?

Standard pricing covers your proposed mark based on the goods and services you describe when you request the search. If the search requires analysis across a significant number of relevant trademark classes, we will confirm any additional scope and fee with you before expanded work begins. You will not be asked to guess whether your matter qualifies.

Can you search a logo?

Yes. The Comprehensive Logo / Design Trademark Search provides the same type of attorney-reviewed clearance and risk analysis, adapted to your proposed logo or design, for $209 per logo/design.

How long does the search take?

Turnaround is generally 1–3 business days after payment is received.

Is a Comprehensive Search required before filing?

No. It is a separate service you can choose if you want a deeper clearance and legal-risk review before you commit to a mark or decide how to file.

How is this different from the Quick Search included with the filing package?

The Quick Search is a preliminary USPTO screening included with the $500 filing package and is designed to support an application you are ready to file. The Comprehensive Search is a separate, more extensive service that reviews similar marks, related goods and services, and common-law/marketplace use, and provides a written risk assessment to help you decide whether to invest in and file the mark in the first place.

Does a favorable search guarantee registration?

No. No search can guarantee registration. The USPTO independently evaluates every application and makes the final determination.

Does the search guarantee that no one else has rights in a similar mark?

No. No trademark search can guarantee that every potentially conflicting use will be identified. Common-law rights can exist outside easily searchable sources, and the analysis reflects information reasonably available at the time of the search.

Can I ask questions after I receive the report?

Yes. A brief follow-up by email regarding the report is included. Phone discussion may be available depending on the questions and circumstances.

Before You File

Not sure about your proposed mark?

If you are weighing whether to invest in a name, logo, or brand, a Comprehensive Search can help you make that decision with a clearer picture of the risk before you file.
